Massachusetts College Student Housing Rule: "No More Than Four"

With thousands of college students set to invade Massachusetts the next week, theApt for Rent.jpg Chief of Boston's Inspectional Services Department is letting local landlords know that he intends to enforce an eight year old ordinance barring no more than four undergraduate students from living together in off-campus apartments and houses.

Massachusetts officials want landlords to report the number of undergraduates living in each unit. Landlords would report that information when they register each unit annually, which is a requirement the city of Boston established in 2013. 

In a tragic case involving the death of a college student, the Court concluded that the Massachusetts lodging house law did not apply in circumstances in which four unrelated adults, who were college students, occupied apartments leased from the defendant property owners, where the apartments as occupied were not "lodgings" so as to render the defendants' properties "lodging houses" under the act." 

This decision is in direct violation of the state sanitary and building codes which provide maximum occupancy levels based on the square footage of the unit.
