With the explosive growth in the cost of financing a college education, the issue of who will pay those costs after the divorce of the parents is becoming increasingly acute.

In determining if college expenses are reasonable where there is a merged agreement binding both parents to share the expenses, the Appeals Court stated that factors to be considered include the financial resources of both parents, the standard of living which the child would have enjoyed if there had been no divorce of the parents, the financial resources of the child, the cost of the school, the programs offered by the school, the child’s scholastic aptitude, how the school meets the goals of the child, the benefits the school offers the child and the extent which a party may have been unjustifiably excluded from the college decision-making process.
